1. The public consideres the facilities with the list of

Activity and other highly ecologically dangerous faciliti-

es, assesses the facilities according to different criteria which may be expressed in quantity, size, weight, volume etc. If the proposed activity will lead to enhancement of These criteria, the public will reveal the key environmental impact as a result of possible implementation of the main project or its options.

1. The public participates in:

· public hearings;

· Informative sessions of the public;

· Creation of public  advisory groups;

· Groups of pereodic dissemination of information;

· Publications in press;

· Statements, expert conclusions etc.

2. The public includes in the regulatory acts of EIA

· Statements which will demand the interested party to publish information in mass media, on the intent to conduct EIA;

· Requirements of the project which can be answered only through mass media.

4. The public organizes committees of public activities committees of public activities which may include groups of people representing all layers of the population, grups of environmental interest and businessmen.. These committees may be in key position for  environment of participation of the public by

disseminating information on the project of appointed public representatives of the project environment.

1. Preparation of preliminary EIA

a) Interested party

· Discusses with the public the deter

mination of those alternative projects  which are necessary for study feasible options;

· Informs the public on important

locating the facilities  from the point of view of environmental capacity of the territory;

· the state of the

environment where the facilities will be located;

· the availability of

ecolojical prognoses;

Issues and changes in the elaborated projects as they may occur;

· Ask the public for help on Environmental issues

in describing ecological conditions and on which the proposed project could have a potential impact;

· Envisages potential confhlicts and helps in

discussing controversies between interested parties at initial stages;

· Determines ecological intermediaries to expedi

te the examination of the whole list of issues and allows  the public and some citizens to make a substantiated choice as to the use and risk

connected with the proposed action;

b)  The interested party is obligated to:

Organize public hearings (one or several) in feasibilit

y studies approving suitable timetable with the public

· conformity of

proposed activity with prospects of socioeconomic

development of the area;

· the record of

integrated (combined) impact of harmful factors and facilities on the

environment;

The public submits its proposals in written form to the interested party

2. The interested party submits an EIA report (published final report for this stage) jointly with feasibility studies for comments

 The public:

· receives from the interested party for considering

the published EIA plan in feasibility studies;

· makes demands on giving enough time for public

consideration and comments;

· elucidates activity in mass media;

· sends comments on final EIA document in feasibility

studies either on separate issues or as a separate document summarising public response.

3.Preparation of final EIA document in fasibilitystudies

The public :

· receives from the interested party the final EIA report

(interrated EIA) in the feasibility studies ;

· are convinced that:

- the documents of integrated  EIA in  feasibility studies prepared for submitting to state expertise guarantee the environmental safety for life and health people;

- environmental, economic and social  interests are balanced;

 - are scientifically justified ;

- are objective;

-issues are considered in a complex-there are actual  alternative

- are discussed openly;

- are fulfilled  in adherence to acting legislation;

- public opinion is considered;

- the documents are properly drawn up (signatures of executors including the chief engineer, sealed, as the chief engineer bears juridical responsibility for proper use of  norm documents in the calculations carried out)

4.Draving up statements of ecolojical consequences of

activity. The abridged version of the statement is published in press

The public attracts the attention to the publication through press, TV, radio, other means and comments on EIA elaboration, conformity of feasibility studies, with  acting legislation etc

Approval and confirmation of feasib

ility studies.1.The interes

  ted party (sponsor) is obligated:

· to preliminary approve  the

materials submitted for state

ecological expertise with interested parties (conclusions of landusers if the land is not reserve, of corresponding coun

cils, architectural, landuser, epidemological and nature conservation agencies);

· the submitted documents

should have an assessment of possible social consequences;

2. The conclusion of the state eco

logical expertise after confirmation of the Ministry of Ecological Safe

ty is obligatory for fulfillment.

3. Positive conclusion of the State ecoexpertise is:

·    the basis for open financing;

·    the document substantiating the choice of the site (route) of construction.

4.  4. Choice of the site (route) of construction

For drawing up an Act of  the choice of the site the interested party is obligated to:

·  organise a committee for carrying

· out the procedure of choice of the site (route) of construction from in

· terested organisations andagencies of State inspection, of the public;

·    go with the commission to the

· site where the act of choice of the site (route) is to be signed;

Ecological expertise of EIA materials is conducted in feasibility studies.

The interested party should (sponsor):

· fulfil state ecolojical expertise of EIA materials in feasibility studies;

for facilities having a hidh ecological hazard, the state ecological expertise is carried out after the interested party makes the statement public on ecological consequences of activity taking into consideration the impact of dangerous factors and facilities on the environment

· Statements

on conducting social ecological expertise are submitted to corresponding Councils of deputies, agencies of state executive power and state ecological expertise;

· the results of public ecological expertise are submitted to mass media, local government and state  ecological expertise agencies for consideration of public  ecological expertise;

ecological-expert agencies or others after finishing ecological expertise inform the mass media about the results
